Who we are

These terms apply to services provided by Zylon Internet B.V., established at Zernikepark 12, 9747 AN Groningen, Chamber of Commerce (KvK) 89748468, VAT NL865089978B01.

Scope of the service

We provide telephony, number lists, recording and reporting services and the technical infrastructure that goes with them. The precise scope of the service offered follows from the agreement, the order forms and the product descriptions on this website.

We may make availability of a service dependent on the operation of third parties, including telecom operators. We ensure reasonable availability and actively maintain our own infrastructure.

Fair use

The service is intended for legitimate business use. Improper use, including spam, call circles, scraping, circumventing usage limits and breaching the security of a third party, is not permitted. We may temporarily or permanently block a number or a service in the case of abuse, or where this is needed to prevent harm to third parties.

Prepaid credit

Where prepayment or a prepaid balance applies, usage is deducted from the available balance. The balance does not expire. If a credit remains unused for more than twelve months, we may refund it to the customer or offset it against outstanding invoices.

Rates and usage are shown transparently. We do not charge for services that were not delivered or that fall outside the agreement, unless we have made that clear in writing beforehand.

No guarantee of delivery

We aim to deliver calls as reliably as possible, but we do not guarantee delivery of any call or message. Network partners, exchanges, roaming partners and other third parties may delay, block or alter calls. This is an inherent characteristic of telephony and network services and is separate from our commitment to quality.

We give no guarantee that a specific number, network or country is reachable.

Liability

We are liable for direct damage arising from an attributable failure in our service, capped at the amount the customer paid us for the relevant service in the twelve months before the damage arose.

Indirect damage, including consequential loss, loss of profit, revenue, data or traffic, is excluded. This exclusion does not apply in cases of intent or deliberate recklessness, or where the law does not permit it.

Termination without notice, breaching number list rules or failing to comply with the permitted-use provisions, may result in immediate termination without compensation.

Privacy and security

How we process personal data, recordings and number lists is described in our privacy policy.

Governing law

All agreements with us are governed by Dutch law. Disputes are brought before the competent court in the district of Groningen, unless the law compels otherwise. Consumers may use the European online dispute resolution platform.

Changes

We may amend these terms. The version in force at the moment the service is used applies. Amendments are published on this website; for significant changes we send a message to the contact address associated with the service.
